These terms and conditions form an agreement between you (hereafter referred to as “CLIENT”) and Rizza Untalan, the designer behind Fieriz Book Cover Design (hereafter referred to as “DESIGNER”). The information entered by the CLIENT is a legally binding signature of everything contained within this agreement.

PAYMENT

The CLIENT agrees to complete the payment of each artworks ordered pending delivery. The DESIGNER will send an invoice to the email address provided by the CLIENT. Payments will be done through Paypal. The CLIENT can book a custom cover and illustration without upfront payment which the DESIGNER can grant the first five rounds of revisions for book covers and the first three rounds of revisions for full illustrations (sketches only for illustrations). The payment will be required for the DESIGNER to continue working on the artwork. It's the CLIENT to decide if he/she/they will proceed with the project through completing the payment before/until the free rounds of revisions are done.

The DESIGNER may purchase up to ten images only from stock photo providers like Depositphotos for a project. If the CLIENT asks the DESIGNER to use additional images, 1 USD per additional image will be added to the total CLIENT’s bill. The CLIENT agrees that if he/she/they will cancel the project, no artwork files will be delivered to the CLIENT.


LICENSE AND OWNERSHIP

Upon receipt of full payment, DESIGNER grants the CLIENT exclusive license to use the final book cover design for his/her/their book and promotional materials for his/her/their book excluding the rights to modify and resell it, which rights is retained by the DESIGNER. The DESIGNER retains the rights to use and publish the completed artworks and their drafts in her portfolio, website, and all social media platforms. The DESIGNER retains the rights to all the materials used except for the materials the CLIENT provided. The DESIGNER has the right to use any drafts to their discretion on other works. The DESIGNER is not liable for any misuse of the final product made by CLIENT.

For fully illustrated artworks, the DESIGNER grants the CLIENT the license to use the artworks for personal and commercial purposes. The CLIENT is not allowed to sell the illustrated artwork in digital format. The CLIENT and the DESIGNER can discuss and have agreements regarding permissions via email.

The DESIGNER retains the copyright of the artwork. The CLIENT agrees to not alter/modify the completed artwork in any way except to change size for printing or digital display. The CLIENT agrees to consult the DESIGNER for any alterations needed after the delivery of the artwork and may cost additional fees.


CREATION ACKNOWLEDGES

The CLIENT grants the DESIGNER the right to include, in small print, the following on the imprint page of the eBook and/or Print Book:

LICENSE OF USED MATERIALS

The CLIENT agrees by the terms of all license agreements for any materials used by the DESIGNER. This includes the Standard license agreements of Stock Photo Providers such as Depositphotos, etc. The Standard license is limited to a print run of 500,000 units. The CLIENT agrees to purchase the Extended licenses of the images used if the print runs over 500,000 units. The DESIGNER will give the images’ information if ever the CLIENT needs the Extended licenses. Standard Licenses do not cover merchandising. Physical products such as bookmarks, mugs, t-shirts, etc. are also not covered. If the CLIENT orders the PSD file of the book cover, he/she/they will be made aware that some elements in the Adobe Photoshop PSD file will need new licensing for further use. The CLIENT acknowledges that he/she obtains all the rights, permissions, validity of copyrights, trademarks and ownership of all the materials he/she will provide to the DESIGNER for the project. The DESIGNER will NOT be liable for any and all copyright and permission infringement action resulting from materials CLIENT provides. No AI-generated images were and will be used in the design, as known by the DESIGNER.


REFUND

All deposits and full payments made by the CLIENT cannot be refunded. Each book covers and illustrations sold will not be available for others to buy. The CLIENT can only cancel an unfinished project but the deposits and payments done will not be refunded. However, if the DESIGNER fails to provide the final artwork to the CLIENT due to problems on DESIGNER's side, a full refund will be issued to the CLIENT.


REVISIONS

The DESIGNER grants unlimited time to plan and discuss ideas with the CLIENT through written correspondence. The DESIGNER grants a maximum of twenty rounds of revisions for the book cover design, the first five can be requested without payment upfront. The DESIGNER grants a maximum of fifteen rounds of revision for fully illustrated artworks, the first three can be requested without payment upfront. If the CLIENT asks for additional rounds of revision, an additional cost will be needed and communicated by the DESIGNER. Once the artwork has been approved and delivered, the CLIENT can still ask for additional revisions but may have an additional cost.


CONFIDENTIALITY

All CLIENT information and materials are considered confidential and only for use by the DESIGNER to provide a quote or complete a project. CLIENT information and project materials will not be shared with any third party, unless requested by the CLIENT.

The same way, if the CLIENT gets access to any of the DESIGNER information, it shall be considered confidential and will not be shared with anyone else outside Fieriz Book Cover Design. DESIGNER will not be held liable when an artwork is deemed similar to other artworks merely based on general trends, themes, and genres.

The CLIENT grants the DESIGNER the right to use and publish the review of the artworks and/or service provided by the CLIENT including the CLIENT’s author name, pen name, and book/illustration title for promotional purposes in her portfolio, website, and all social media platforms.


LIABILITY

CLIENT indemnifies and holds harmless DESIGNER against any and all claims, actions, demands, loss, injury, errors, etc. arising from the use of the book cover/illustration. This includes, but is not limited to, actions involving using copyrighted images that CLIENT may have provided without proper licensing. This agreement is the entire agreement of all parties. No additional conditions or promises apply to this agreement that are not included herein.
